EU AI Act for hotels: what applies when.
On August 2, 2026 it gets serious: chatbots and phone assistants must identify themselves as AI. At the same time, other deadlines have just been postponed. Here is what actually matters for your hotel. As of July 2026.

What is the EU AI Act?
The EU AI Act is the world's first comprehensive AI law and regulates the use of artificial intelligence by risk category. It has been in force since August 1, 2024 and takes effect in stages. The obligations also hit businesses that merely use AI, not just those who build it.

Since February 2, 2025
Affects hotelsBans + AI literacy requirement
Certain AI practices are banned (e.g. social scoring). More important for you: if you use AI in your operation, you have to make sure your team knows how to handle it (Article 4). That rule is already in force.
Since August 2, 2025
Obligations for AI model providers
Affects OpenAI, Google and the like, not your hotel directly. You benefit indirectly: providers have to become more transparent.
From August 2, 2026
Affects hotelsTransparency requirement (Article 50)
Chatbots and voicebots must identify themselves as AI no later than the first interaction. A note in your legal page is not enough. This deadline was NOT postponed.
From December 2, 2026
Affects hotelsLabeling of AI-generated content
AI-generated images, video and audio must carry a technical marker identifying them as such. Affects you if you use AI images in your hotel marketing.
From December 2, 2027
High-risk AI (postponed)
The strict rules for high-risk systems were supposed to start on August 2, 2026 and were pushed back 16 months by the Digital Omnibus. Relevant for hotels e.g. when AI is used to screen job applicants.
From August 2, 2028
High-risk AI in regulated products
The final stage, covering AI built into regulated products. Irrelevant for day-to-day hotel operations.
What did the Digital Omnibus change?
The Digital Omnibus was adopted by Parliament and Council in June 2026 and pushes the high-risk obligations back 16 months, to December 2027 and August 2028. The transparency requirements under Article 50 are explicitly excluded and apply unchanged from August 2, 2026.
What that means for you: the deadline that hits your hotel most directly is coming right on schedule. If you were hoping for a delay, you now have one month left.
The 5 things your hotel should sort out before August 2, 2026
None of them needs an IT department. All together it's one afternoon plus one phone call to a vendor.
Label your chatbot and voicebot as AI
Your website chat and your phone assistant must introduce themselves as AI at first contact. For a voice agent that means a clear announcement at the start of the call.
Review AI images and videos in your marketing
List where AI-generated material is running: website, social media, newsletter. From December 2026 it must carry a technical marker, so plan for that now.
Document your team's AI literacy
This obligation has applied since February 2025. A short training session plus half a page of AI guidelines for the team covers most of it for a boutique hotel.
Make a list of every AI tool in the house
ChatGPT at the front desk, translation tool, the chatbot in your booking engine: you can only label what you know about. One hour of work, and you have the full picture.
Check compliance before buying new tools
Ask every vendor how their system handles the labeling requirement. Anyone without an answer is off the list.
What happens if you do nothing?
Violations of the transparency requirement can be fined up to 15 million euros or 3 percent of worldwide annual turnover. For a boutique hotel the more realistic scenario is a cease-and-desist letter from competitors or trade associations — annoying, and avoidable.
Common questions about the EU AI Act in hotels
When does the EU AI Act apply to hotels?
The AI literacy requirement has applied since February 2, 2025, the transparency requirement for chatbots and voicebots applies from August 2, 2026. The high-risk rules start for hotels no earlier than December 2, 2027.
Does my hotel chatbot have to be labeled as AI?
Yes, from August 2, 2026 every chatbot and voicebot must disclose that it is an AI no later than the first interaction. A note in your legal page is not enough.
Was the EU AI Act postponed?
Only partially: the Digital Omnibus, adopted in June 2026, pushes the high-risk obligations to December 2027 and August 2028. The transparency requirements under Article 50 apply unchanged from August 2, 2026.
What are the penalties for violating the transparency requirement?
Article 99 provides for fines of up to 15 million euros or 3 percent of worldwide annual turnover. For smaller operations the more realistic risk is a cease-and-desist letter from a competitor, which still gets expensive.
Do I have to label AI-generated images on my hotel website?
Yes, AI-generated images, videos and audio must be identifiable as such, and the technical marking requirement tightens from December 2, 2026. Real photos of your property are not affected.
What is the AI literacy requirement in Article 4?
Businesses that use AI must make sure their staff have a sufficient understanding of it. It has applied since February 2, 2025 and covers small hotels too.
Is a voice agent in a hotel high-risk AI?
No, a phone assistant handling guest questions and reservation requests falls under the transparency requirement, not under high-risk. In a hotel, high-risk is most likely with AI in HR, for example applicant screening.
